What Is Lyft Sexual Assault?

Criminal sexual assault is a Class 1 felony in Illinois. Lyft sexual assault can be committed by a Lyft driver or someone else riding in the vehicle. According to 720 ILCS 5/11-1.20, “A person commits criminal sexual assault if that person commits an act of sexual penetration and:

  • Uses force or threat of force;
  • Knows that the victim is unable to understand the nature of the act or is unable to give knowing consent;
  • Is a family member of the victim, and the victim is under 18 years of age; or
  • Is 17 years of age or over and holds a position of trust, authority or supervision in relation to the victim, and the victim is at least 13 years of age but under 18 years of age.”

Lyft sexual assault may include inappropriate touching or groping, touching of the private parts, nonconsensual kissing, attempted rape or rape, or sodomy during a Lyft ride. Crimes involving a rideshare vehicle may also include kidnapping or physical assault.

Who Can Be Held Liable for Lyft Sexual Assault?

Lyft, Inc. can often be held responsible for crimes committed by its drivers. Although Lyft drivers in Illinois are classified as independent contractors, the law can hold Lyft liable for hiring a known sex offender or failing to respond to previous sexual misconduct complaints made against a driver.

Lyft has an insurance policy that offers up to $1 million in coverage for injuries to passengers. It may also be possible to take legal action against the individual Lyft driver or passenger who assaulted you.
